1. Definitions
1.1 “S2”, “Company”, “we”, “us” or “our” means S2 Car Rental Services.
1.2 “Customer”, “Renter”, “you” or “your” means the person booking, accepting, possessing, driving or using the Vehicle.
1.3 “Vehicle” means the car or other vehicle provided by S2 under the applicable rental arrangement.
1.4 “Rental Period” means the period beginning from the agreed vehicle handover time and ending at the agreed vehicle return time.
1.5 “Applicable Law” means the Motor Vehicles Act, 1988, rules and regulations made thereunder, and all other applicable laws, rules, regulations, notifications and government requirements.
2. Booking & Rental Period
2.1 The rental period, vehicle, rental rate, minimum running, extra kilometre charges, security deposit and other applicable charges shall be communicated at the time of booking.
2.2 Depending on the booking arrangement, the rental may be calculated on an hourly, daily or package basis.
2.3 The Customer must return the Vehicle on the agreed date, time and location.
2.4 Any extension of the Rental Period must be approved by S2 before the original return time.
2.5 Any extension without prior approval may result in additional rental/usage charges and other appropriate action as permitted by law.
3. Payment Terms
3.1 The Customer shall pay the applicable rental amount and all other charges communicated at the time of booking.
3.2 Depending on the booking, the Customer may be responsible for:
- Security Deposit
- Extra KM Charges
- Extra Usage/Time Charges
- Toll Charges
- Parking Charges
- State/Border Taxes
- GST and other applicable taxes
- Government charges
- Cleaning/Sanitization Charges
- Damage/Repair Charges
- Traffic Fines/Challans
- Other recoverable charges arising from the Customer’s use of the Vehicle.
3.3 All outstanding amounts must be cleared as communicated by S2.
4. Delayed Return & Additional Charges
4.1 The Vehicle must be returned at the agreed date and time.
4.2 Any delay in returning the Vehicle may attract additional rental or usage charges.
4.3 Applicable taxes, including GST, may apply to additional charges.
4.4 Retention of the Vehicle beyond the agreed Rental Period without approval may be treated as unauthorized use, subject to Applicable Law.
5. Vehicle Handover & Condition Record
5.1 At the time of handover, S2 may record:
- Vehicle photographs
- Odometer/meter reading
- Vehicle video
- Exterior condition
- Interior condition
- Existing scratches, dents or damages
- Fuel level
- Accessories
- Keys
- Vehicle documents
5.2 These records may be retained by S2 for vehicle condition verification and operational/security purposes.
5.3 The Customer should inspect the Vehicle at the time of handover and immediately inform S2 of any discrepancy.
5.4 Handover photographs, videos, odometer readings, fuel records and condition records may be used as reference during the return inspection.
6. Vehicle Return Condition
6.1 The Customer must return the Vehicle in substantially the same condition in which it was handed over, subject to normal wear and tear.
6.2 The Vehicle must be returned with the same fuel level as at handover. Any fuel shortage may be charged to the Customer.
6.3 Any new damage, dent, scratch or other damage occurring during the Rental Period may be recoverable from the Customer, subject to the applicable rental terms, insurance policy and Applicable Law.
6.4 All keys, documents, accessories and other items provided with the Vehicle must be returned.
6.5 Loss or damage to accessories, keys, documents or other supplied items may result in applicable repair or replacement charges.
6.6 The Vehicle must be returned in a reasonably clean condition.
6.7 Cleaning, sanitization, repair or replacement costs arising from vomiting, food, drinks, liquid spills, stains or similar incidents may be charged to the Customer.
6.8 Smoking inside the Vehicle or causing excessive/bad odour may result in applicable deep-cleaning and sanitization charges.
7. Security Deposit
7.1 A refundable Security Deposit may be collected depending on the Vehicle and booking arrangement.
7.2 The Security Deposit may be adjusted against legitimate outstanding amounts, including:
- Vehicle damage
- Repair costs
- Dents/Scratches
- Excessive cleaning
- Sanitization
- Missing/Damaged Accessories
- Fuel shortage
- Unpaid rental charges
- Additional usage charges
- Traffic-related dues
- Other recoverable amounts arising from the rental.
7.3 The balance Security Deposit, if any, shall be processed for refund after necessary inspection, verification and settlement of applicable dues.
7.4 Processing, banking or payment reversal charges may be deducted where applicable and legally permissible.
8. Special Security Deposit – Two-Wheeler
8.1 Where specifically agreed between S2 and the Customer, a two-wheeler may be voluntarily provided as security for the agreed rental/security arrangement.
8.2 The Customer shall provide appropriate details/documents relating to the two-wheeler as required by S2.
8.3 The Customer confirms that the two-wheeler is lawfully possessed/owned and is not subject to any undisclosed valid third-party claim or restriction.
8.4 S2 shall retain the two-wheeler only for the agreed security purpose and period, subject to Applicable Law.
8.5 The security vehicle shall not be sold, transferred, pledged or otherwise disposed of except through lawful process and as permitted by Applicable Law.
8.6 Upon completion of the rental arrangement and settlement of applicable dues and liabilities, the security vehicle/documents shall be returned as agreed between the parties.
9. Driving Licence & Eligibility
9.1 The Customer must possess a valid driving licence appropriate for the Vehicle being rented.
9.2 The Customer must provide genuine, valid and accurate documents/information required by S2.
9.3 The Customer shall comply with all applicable motor vehicle, traffic and road-safety laws.
9.4 The Vehicle shall only be driven by persons authorized under the applicable booking/rental arrangement.
10. With-Driver Bookings – Duty Hours
10.1 For bookings where a Vehicle is provided with a driver, one day of driver duty shall normally be calculated on a maximum 12-hour duty basis unless otherwise agreed at the time of booking.
10.2 Additional duty hours, if applicable, may attract additional charges as communicated by S2.
10.3 Minimum running, driver allowance, night charges, toll, parking, state/border taxes and other applicable charges shall be as communicated at the time of booking.
11. Driving Rules
11.1 The Customer must drive carefully and responsibly.
11.2 The Customer must follow applicable speed limits, traffic signals and road regulations.
11.3 Driving under the influence of alcohol or drugs is strictly prohibited.
11.4 Racing, dangerous driving, negligent driving or any unlawful use of the Vehicle is prohibited.
11.5 The Vehicle must not be overloaded.
11.6 The Customer shall not allow an unauthorized person to drive or use the Vehicle.
11.7 The Customer shall be responsible for consequences arising from unlawful, negligent or unauthorized use, subject to Applicable Law and applicable insurance terms.
12. Accident, Injury & Emergency
12.1 In case of an accident, injury or emergency, the Customer must first take reasonable steps to ensure personal safety and obtain medical assistance where required.
12.2 The Customer must inform S2 without undue delay.
12.3 The police or relevant authorities must be informed wherever legally required.
12.4 The Customer should take reasonable photographs/videos of the accident scene and vehicles involved.
12.5 The Customer should collect relevant details of other vehicles/persons involved where appropriate.
12.6 The Customer must cooperate with S2, authorities and the applicable insurance process.
12.7 The Customer must not abandon the Vehicle except where reasonably necessary for safety or as required by authorities.
13. Insurance & Liability
13.1 Vehicle insurance shall apply as per the relevant insurance policy and Applicable Law.
13.2 Insurance coverage may be subject to exclusions, deductibles, excess amounts and policy conditions.
13.3 The Customer may be responsible for losses or expenses arising from negligence, misuse, unauthorized use, policy violations or acts that cause insurance coverage to be denied or restricted, subject to the applicable insurance policy and Applicable Law.
13.4 Third-party liabilities arising from the Customer’s unlawful or negligent use may also be recoverable from the Customer where legally permissible.
14. Post-Accident Responsibilities
After an accident, the Customer should, wherever reasonably possible:
- Take photographs/videos of the scene and Vehicle
- Record relevant witness/vehicle details
- Inform S2 immediately
- Inform the police where required
- Cooperate with the insurance process
- Follow instructions provided by S2 and relevant authorities.
15. Insurance Excess / Deductible
15.1 Where applicable, the Vehicle’s insurance policy may contain an excess or deductible.
15.2 The applicable amount and Customer’s responsibility shall depend on the Vehicle, insurance policy, rental arrangement and circumstances of the incident.
16. Prohibited & Unlawful Use
The Vehicle must not be used for:
- Illegal or criminal activities
- Racing or speed competitions
- Carrying prohibited substances
- Unauthorized transportation of goods
- Unauthorized commercial activities
- Any activity prohibited under Applicable Law
- Any activity that may endanger the Vehicle, passengers or public.
S2 may terminate the rental and take appropriate action where permitted by law.
17. Traffic Violations & Challans
17.1 The Customer is responsible for traffic violations, challans, fines, penalties and related liabilities arising from the Customer’s use of the Vehicle during the Rental Period, subject to Applicable Law.
17.2 S2 may recover such amounts from the Customer where legally permissible.
18. Speeding Policy
18.1 For safety purposes, the Customer must not exceed 100 KM/H, subject always to the legally applicable speed limit and road/location conditions.
18.2 Where a speeding violation is established based on available evidence such as GPS/telemetry, photographs, videos, official records or other reliable records, the following internal penalty structure may apply:
- First Violation: ₹200/-
- Second Violation: ₹500/-
- Third Violation: ₹1,000/-
- Maximum cumulative internal speeding penalty under this structure: ₹1,700/-.
18.3 Repeated or serious speeding may result in termination of the rental and/or Vehicle retrieval, subject to Applicable Law.
18.4 Government challans, fines or other legal penalties are separate from the above and may also be payable by the Customer.
19. Spare Parts & Repair Costs
19.1 Replacement or repair arising from damage, misuse, negligence or unauthorized handling may be charged at applicable actual cost, subject to the rental arrangement, insurance policy and Applicable Law.
19.2 The Customer must not authorize major repairs without prior approval from S2 except where immediate action is reasonably necessary for safety.
20. Tyre Misuse & Puncture
20.1 The Customer must take reasonable care of the Vehicle’s tyres.
20.2 Damage caused by negligent driving, unsuitable terrain, misuse, avoidable punctures or continued driving with a damaged/punctured tyre may result in applicable repair or replacement charges, subject to the circumstances and Applicable Law.
21. Use of Vehicle in Damaged Condition
21.1 The Customer must not continue driving the Vehicle if doing so is likely to cause further damage or create a safety risk.
21.2 Damage caused by continued operation after a serious warning or known mechanical issue may be recoverable from the Customer where legally permissible.
22. Deliberate Driving in Water
22.1 The Customer must not deliberately drive the Vehicle through deep water or waterlogged areas where doing so may reasonably cause damage to the engine, electrical system, mechanical components, tracking equipment or safety systems.
22.2 Damage caused by such use may be recoverable from the Customer, subject to the applicable insurance policy, rental terms and Applicable Law.
23. Prohibited Items & Activities
23.1 The Customer must not use the Vehicle for transporting or handling illegal or prohibited items, including arms, ammunition, narcotics or banned substances, except where expressly permitted under Applicable Law and authorization.
23.2 Unauthorized commercial use, including passenger transportation for payment, unauthorized goods transportation, advertising, promotion, sale or delivery activities, is prohibited unless specifically agreed in writing.
23.3 Violation may result in termination of the rental and appropriate legal action.
23.4 Where legally permissible, S2 may seek recovery of actual losses and applicable contractual charges up to ₹50,000/-.
24. External Branding, Stickers & Advertising
24.1 The Customer must not place, apply, remove or modify any sticker, advertisement, branding, promotional material, decal or signage on or from the Vehicle without prior written permission from S2.
24.2 Unauthorized branding or damage may result in applicable restoration, removal and repair charges and contractual charges, subject to Applicable Law.
25. Odometer, GPS & Safety System Tampering
The Customer must not:
- Tamper with the odometer
- Disconnect or damage GPS/tracking devices
- Remove or manipulate tracking equipment
- Tamper with safety systems
- Disable or damage vehicle monitoring equipment
- Attempt to conceal vehicle usage or location.
Unauthorized tampering may result in applicable charges, including repair/replacement costs, subject to Applicable Law.
26. False or Misleading Documents
26.1 The Customer must provide genuine, valid and accurate information and documents.
26.2 Submission or use of forged, fake, altered or tampered documents may result in cancellation/termination of the rental and appropriate civil or criminal action as permitted by law.
26.3 Applicable contractual charges and actual losses may also be recovered where legally permissible.
27. Restricted & Prohibited Areas
27.1 The Customer must not take the Vehicle into areas where vehicle entry or use is prohibited or restricted by law, government authorities, local regulations, insurance conditions or S2’s applicable rental restrictions.
27.2 This may include certain restricted, border, government-controlled, security-sensitive or otherwise prohibited areas.
27.3 The Customer should inform S2 in advance about significant changes to the planned route where required by the booking arrangement.
27.4 Vehicles may use GPS/tracking technology for safety, security and operational purposes.
27.5 Unauthorized diversion into restricted areas may result in applicable recovery, retrieval, additional charges or termination of the rental, subject to Applicable Law.
28. Vehicle Return Terms
28.1 The Customer must return the Vehicle at the agreed location and time.
28.2 The Vehicle must be returned with the agreed fuel level.
28.3 All keys, documents and accessories must be returned.
28.4 The Customer should ensure that no personal belongings remain inside the Vehicle.
28.5 The Customer must inform S2 about any accident, damage or mechanical issue.
28.6 Excessive dirt, stains, food/drink spills, vomiting, smoking-related contamination or bad odour may result in applicable cleaning/sanitization charges.
29. Customer Responsibility
During the Rental Period, the Customer is responsible for proper custody and lawful use of the Vehicle. The Customer must not:
- Hand over the Vehicle to an unauthorized person
- Misuse or abuse the Vehicle
- Alter or modify the Vehicle
- Remove any Vehicle component or accessory
- Tamper with tracking/safety equipment
- Use the Vehicle for prohibited activities
- Ignore warning signs or known serious mechanical issues
- Use the Vehicle in a manner likely to cause avoidable damage.
Recoverable losses, expenses, penalties and charges arising from such conduct may be payable by the Customer, subject to Applicable Law, insurance and rental terms.
30. Vehicle Documents & Accessories
30.1 The Customer must return all items provided with the Vehicle, including where applicable:
- Vehicle Keys
- Registration Certificate (RC)
- Insurance Documents
- Pollution Certificate
- Other Vehicle Documents
- Accessories
- Equipment provided by S2.
30.2 Loss, theft, damage or non-return of such items may result in applicable recovery, repair or replacement charges.
31. Cancellation & Rescheduling
31.1 Booking amounts or advance payments may be non-refundable unless otherwise specifically agreed by S2 or required under Applicable Law.
31.2 Cancellation, rescheduling and refund conditions may vary depending on the Vehicle, booking type, Rental Period, advance amount, date of cancellation and special booking arrangements.
31.3 The cancellation/refund terms communicated at the time of booking shall apply.
32. Customer Acceptance & Declaration
By booking, accepting, possessing, driving or using the Vehicle, the Customer confirms that:
- They have read and understood these Terms & Conditions.
- The information and documents provided by them are genuine and accurate.
- They will comply with Applicable Law.
- They will follow S2’s vehicle-use and safety requirements.
- They accept the applicable rental, payment, deposit and additional-charge conditions.
- They understand their responsibilities regarding vehicle condition, accidents, traffic violations, insurance and Vehicle return.
Violation of these Terms may result in applicable charges, recovery of losses, termination of the rental and/or legal action, subject to Applicable Law.
33. Privacy & Customer Information
33.1 S2 may collect and process customer information, documents, photographs, vehicle-condition records, booking information, payment information and other relevant data for purposes including:
- Booking and rental management
- Customer verification
- Vehicle handover and return
- Payment processing
- Security and fraud prevention
- Insurance and legal requirements
- Customer support
- Business records.
33.2 Customer information shall be handled in accordance with S2’s applicable Privacy Policy and Applicable Law.
34. Governing Law & Jurisdiction
34.1 These Terms & Conditions shall be governed by the applicable laws of India.
34.2 Subject to Applicable Law, courts having jurisdiction at Indore, Madhya Pradesh shall have jurisdiction in relation to disputes arising from the rental arrangement.

Vehicle photographs, videos, odometer readings, fuel levels and condition records may be taken at handover and return for verification purposes.
